New Sunscreen Recall Lawsuits
There are a number of new lawsuits based on the faulty Johnson & Johnson sunscreen recall, with the first cases centered on a consumer fraud claim. These lawsuits allege that the company deceived consumers into purchasing recalled sunscreen products and failed to warn them of the risk of skin cancer. While these claims are not successful, they do provide evidence that the product caused a number of victims to develop leukemia or certain types of cancer.
Benzene is an industrial solvent found naturally in crude oil. It is not necessary to add it to sunscreen, but certain batches of the sun cream contained levels of benzene that were over the FDA limit. According to Dr. Christopher Bunick, an associate professor of dermatology at Yale University, even a small amount of benzene in sunscreen can expose individuals to excessive nanograms of benzene. In order to file a sunscreen recall lawsuit, you must have used a sunscreen with benzene content.
According to Valisure, an independent pharmaceutical company, benzene was detected in Neutrogena sun care products in two hundred and ninety-four batches. This prompted the company to recall five different brands of the brand. In addition to Neutrogena, Goodsense and Sun Bum sun care products were recalled, as they contained high levels of benzene. The company defended the voluntary recall by saying it was done out of caution.
Another recent Sunscreen recall lawsuits involved the Johnson & Johnson sun screen. In this lawsuit, the company sought to reimburse victims of the recalled product. The company is facing a class-action lawsuit filed in California. The lawsuit seeks compensation and injunctive relief for victims. Sunscreen manufacturers have a duty to warn consumers of potentially harmful chemicals. They also owe consumers adequate information on the hazards of aerosol sunscreens. In addition to compensation, it is possible to seek an injunction against the company that failed to disclose the risks involved.
This lawsuit is based on the benzene content of the recalled Sunscreen. It may have been contaminated during manufacturing. The FDA also issued a report saying that Benzene was found in 78 lots of the sun care products. While the FDA has yet to make a decision about the cause of the problem, the company has voluntarily recalled the affected lots. There are also other lawsuits related to the Sunscreen Recall that have been filed against the company.
The Beasley Allen law firm filed a class-action lawsuit on behalf of benzene-tainted Aveeno and Neutrogena sun-care products. The Valisure lab found alarming levels of the chemical benzene in at least 78 sun-care products. The lawsuit is being filed in the Southern District of Florida. These lawsuits are based on new testing data provided by a patient advocate company.
The benzene-content of the Sunscreen Recall lawsuits is an ongoing issue. The recalled Sunscreen contains Benzene, which is a known human carcinogen. This is especially dangerous if the product is applied for long periods of time. It may cause blood cancer, and you can file a lawsuit against the manufacturer to recover compensation for any damages. These claims will not be easy to win, but if you were exposed to Benzene-contaminated Sunscreen products, you may be entitled to compensation.
